
1. Parties
Agreement is entered into between Castle Estate Management LLC (“Company”)
and active membership holder ("Member").
2. Property Location
The location for services shall be located at active Member's Property.
3. Scope of Services
Company provides:
• Property survey / property condition assessment / maintenance notifications and recommendations
• Vendor referrals and coordination
• Membership or subscription services
• Optional project management for larger services TBA
Company does not directly perform construction, repair, or trade work.
4. Independent Vendor Disclosure
Member acknowledges:
• Company may refer third-party vendors.
• Vendors are independent businesses, not employees or agents of Company.
• Company does not guarantee vendor pricing, timelines, or workmanship.
• Customer contracts directly with vendors at time of service - not through Company
5. Survey / Property Assessment Disclaimer
Property inspections are for information only, visual, and non-invasive.
Company does not guarantee detection of any or all defects, hidden conditions, or future issues.
Reports are informational and not engineering, structural, or code certifications.
Property Survey information and any source data as a result to provide: Castle Score®, conditions, maintenance alerts, budgets, notifications, schedules, recommendations, marketing efforts, blogs, advertising, marketplace deals, discounts, or any other Company Service or business operation is not guarteeed to be accurate.
6. Payment Terms
If Company provides paid services:
• Payment due upon activation unless stated otherwise.
• Subscription renewals (if applicable) auto-renew unless canceled in writing.
• Late payments may result in service suspension.
7. Compensation Disclosure
Member understands:
• Company from time to time may receive compensation or marketing fees from vendors, sponsors, or partners.
• These fees are in a separate agreement and do not increase the Member's price for services in any way.
8. Limitation of Liability
To the fullest extent permitted by law:
• Company’s total liability is limited to the amount paid by Member to Company in the last 12 months.
• Company is not liable for indirect, consequential, or incidental damages.
• Vendor workmanship or payment disputes are between Member and Vendor.
9. Photography, Video & Documentation Consent
member grants Company permission to:
• Take photos or video of the property interior/exterior including bedrooms, bathrooms, or secure locations or items within Property.
• Usage of media to support vendor communication and service
• Use documentation for reporting, insurance support, or internal records
• Use anonymized images for marketing unless Customer opts out in writing
10. Recording Disclosure
For quality assurance and mutual protection, conversations or meetings may be recorded where legally permitted.
11. Privacy & Data Use
Company will:
• Protect Member data
• Not sell personal information
• Use contact information only for service-related communication
12. Cancellation & Termination
Member may cancel services:
• Before service begins for a full refund
• After work begins prorated or no refund depending on service completed
Subscriptions require written cancellation notice prior to renewal.
13. Property Access & Safety
Member agrees to provide safe and lawful access to the property. Company may refuse or discontinue services if
conditions are unsafe or contain illegal activities.
14. Dispute Resolution
Any disputes shall first attempt resolution via good-faith negotiation.
If unresolved, disputes may proceed to mediation or small claims court in the Company’s operating county/state.
15. Governing Law
This Agreement is governed by the laws of the State in Idaho.
16. Entire Agreement
This document represents the entire agreement between parties and supersedes prior discussions.
17. Member Acknowledgment
Member confirms they:
• Understand services are advisory and Company is not a general contractor
• Understand vendors are independent of Company
• Agree to payment and liability terms
• Consent to documentation and communication practices
Property Surveys
1. Initial Property Survey
As part of Membership enrollment, Member may purchase an Initial Property Survey (“Survey”), which may
include:
• Visual exterior and/or interior home condition review
• General maintenance observations
• Non-invasive inspection methods
• Digital report or summary provided to Member
• Logging of data for service assistance and maintenance recommendations
The Initial Property Survey is informational in nature and not a structural, engineering, or code-compliance
certification. Hidden defects or future failures cannot be guaranteed or predicted.
2. Annual Property Survey
To best serve Members, Company performs a voluntary Annual Property Survey (“Annual Survey”), which may
include:
• Previous Property Survey review and updating
• Additional benefits Company has developed
• Verification of projects, new installations, or maintenance over prior 12 months
• Additional data gathering to best serve Member
The Annual Property Survey is informational in nature and not a structural, engineering, or code-compliance
certification. Hidden defects or future failures cannot be guaranteed or predicted.
3. Non-Refundable Nature
The Initial Property Survey is provided as a new member benefit and may carry an advertised or stated retail
value along with a discounted price.
Once the Survey has been completed and a report of findings are delivered, this benefit is considered consumed
and non-refundable, even if Membership is later canceled, except where required by law.
4. Survey Terms
Initial Property Surveys are a one-time charge on the date of membership activation.
Annual Property Surveys are voluntary and occur on the 1-year anniversary of this agreement. Customers will be
informed of discounted rates and additional benefits being offered.
Membership Services & Billing
1. Membership Benefits -
Benefits may include, but are not limited to:
• Priority scheduling
• Vetted vendor services or coordination
• Discount vendor offerings
• Emergency Claim credits or coordination
• Service Event Credits or coordination
• Access to member-only resources or reports
Benefits are non-transferable and hold no cash value unless explicitly stated.
2. Membership Enrollment
Member elects to voluntarily enter Castle Core Membership (“Membership”). Membership provides access to
designated benefits, services, discounts, or credits as described at the time of enrollment and in this agreement.
3. Membership Term
Membership begins on the date of this Agreement and continues on a monthly recurring renewal basis until
canceled or annual recurring renewal basis if Castle Core Annual is opted for.
4. Billing & Auto-Renewal
Member authorizes Company to charge the payment method on file for recurring membership fees on a monthly or annual
basis.
• Membership automatically renews unless canceled in accordance with this Agreement.
• Fees are billed in advance for each renewal period.
• Member is responsible for maintaining valid payment information.
5. Cancellation
Member may cancel Membership at any time by providing written or electronic notice prior to the next billing date.
• Cancellation stops future renewals.
• No refunds are provided for partially used billing periods unless required by law or otherwise stated in writing.
6. Changes to Membership Plans
Company may modify membership pricing, features, or benefits with reasonable notice (e.g., email or written
communication). Continued use of Membership after notice constitutes acceptance of changes.
7. Suspension or Termination by Company
Company reserves the right to suspend or terminate Membership for:
• Non-payment
• Fraudulent or abusive behavior
• Misuse of services or benefits
Termination for cause does not entitle Member to a refund.
8. No Guarantee of Vendor Availability
Membership provides coordination and priority access but does not guarantee vendor availability, response
times, pricing, or project outcomes, as vendors remain independent businesses.
9. Acknowledgment
Member acknowledges that Membership is a convenience and value program, not an insurance policy, warranty,
or guarantee of repairs or savings.
Emergency Credits / Service Credits
As part of an active Membership, Member may be eligible to receive Emergency Claim Credits or Service
Event Credits (“Credits”) that may be applied toward qualifying home service or repair costs coordinated through
the Company.
Credits are intended as a goodwill membership benefit and are not an insurance policy, warranty, or guarantee of
coverage.
1. Annual Credits Limit
• Maximum of Three (3) Credits at a value of $500 per credit for a total of $1,500 over a (12) twelve month rolling period
• Total annual credit value may not exceed $1,500
• Unused Credits do not roll over to future years
2. Per-Incident Limit
• Each individual Credit may not exceed $500
• Credits may only be applied once per qualifying service event or claim event
• Multiple credit applications may overlap if documentation supports seperate events and are seperately eligible.
3. Emergency Claim Credits
Emergency Claim Credits are to be used during a restoration or damage event sustained to property:
• May be used in the event a claim is made through Customer Insurance Carrier in which costs of repairs exceed $7,500
• May be used for property damages or disaster events only
• Must provide documentation, claim number and use Company Vendor to qualify
4. Service Event Credits - Service Event Value
Service Event Credits are to be used when a service is performed above a minimum threshold and timeline:
• May include multiple services being performed within a rolling 60-day period
• Member must document service dates for verification
• Minimum $7,500 Service Event Value to qualify for credit
• Maximum of 3 separate Vendors can be used in calculating total Service Event Value over said 60-day period
5. Eligibility Requirements
To qualify for a Credit:
• Membership must be active and in good standing
• Service Event Value minimum of $7,500 or
• Verified and approved claim documentation of Customer Insurance Carrier exceeding $7,500 in total costs
• Total Service Event Value must include maximum of 3 Vendors
• Vendors used for Service Event Value must be Company Vendors and coordinated by Company
• Vendors used for Emergency Claim Credit must be Company Vendors and coordinated by Company
• Customer must provide documentation, claim number and/or proof of service by Company Vendor
• Customer has satisfied and paid any outstanding invoice from Vendor(s)
6. Non-Qualifying Uses
Credits cannot be applied toward:
• Grouping of services performed by 4 or more Vendors to meet eligibility threshold
• Services are not performed within a 60-day period
• Request for Credit is not made within 90 days of final payment for qualifying services
• Request of Credit without service documentation
• Services have not yet been paid to Vendor(s)
Fraudulently made claims or intentionally inflated Service Values submitted for credits will result in immediate
termination of Membership, denial of credit, and refusal of future service.
7. Verification
Verification will take place prior to credit issuance which include:
• Verifying Service Event Value eligibility
• Verifying Emergency Claim Credit eligibility
• Documentation of events is verified
• Verification that Vendors have been paid for all outstanding services or invoices
8. Credits Issuance
Credits are issued on the 30th day following verification, via check or electronic payment method.
9. Expiration & Termination
• Credits expire immediately if Membership lapses or is canceled.
• Company may deny or reduce Credits in cases of abuse, fraud, or repeated misuse.
• Credits are only applied to valid claims through Member.
• Credits may only be applied to qualifying services.
• Unused credits do not roll over and are not redeemable for cash.
10. No Guarantee of Coverage or Availability
Credits are a discretionary membership benefit and do not guarantee vendor availability, timelines, or service
outcomes.
